Standards for Court-Ordered Spousal Maintenance in Texas

In order for a spouse to be awarded alimony payments in a court in the state of Texas, he or she must be eligible. If you and your spouse are negotiating the terms of your divorce out of court, you can agree on an arrangement that suits you, regardless of court standard eligibility.

In the eyes of the court, a party is eligible if he or she meets the following qualifications:

  • The spouse who is seeking maintenance must not have sufficient property to meet his or her reasonable needs.
  • The paying spouse must have received deferred adjudication or have been convicted of a domestic violence crime that occurred during the marriage or while the divorce was pending, OR, the spouse seeking maintenance must be unable to earn an income that allows him / her to pay for reasonable needs.

The length and amount of alimony will depend on a number of factors, such as:

  • Educational background
  • How long the marriage lasted
  • Occupational history
  • Any infidelity
  • Contributions to the family as a homemaker
  • Attempts to find work
  • The age of the spouse seeking maintenance
